Terms of Use

These Terms govern your use of the Health & Virtuals Talent Platform. They supplement and form part of the Health & Virtuals legal framework, alongside our Privacy Policy. By creating an account, uploading materials, completing the profile wizard, or proceeding through any Talent Platform workflow, you agree to be bound by these Terms.

1. Scope

This document supplements the Health & Virtuals legal framework, including the broader Terms and Conditions of Use, Privacy Policy, Cookie Policy, and Talent Platform and Candidate Terms of Use (collectively, the “Platform Terms”).

These Terms apply specifically to the talent application, applicant profile, onboarding, resume parsing, screening, training enrollment, pipeline management, profile visibility, and candidate data processing functions made available through the Health & Virtuals talent platform (the “Talent Platform”).

In the event of a conflict between these Terms and other Platform Terms, these Terms control with respect to applicant profile, resume parsing, uploaded media, pipeline, and talent data matters described here. The broader Platform Terms govern all other matters.

“Company,” “Health & Virtuals,” “H&V,” “we,” “us,” or “our” means LaCharme LLC, a Florida limited liability company doing business as Health & Virtuals, with its principal place of business at 3919 Tampa Road, Oldsmar, Florida 34677, USA.

2. Candidate Uploads, Profile Photo, and Intro Video

Candidates may be required to upload a profile photograph, resume or curriculum vitae, and a short introductory video as part of the Talent Platform onboarding workflow.

By uploading a profile photograph or introductory video, you grant the Company a limited, non-exclusive, revocable where legally required, worldwide license to store, process, display, transcode, review, reproduce internally, and share such media for candidate identification, screening, recruiter review, training eligibility, client evaluation, shortlist presentation, and platform administration.

Profile photographs may be displayed on candidate profiles visible to authorized internal personnel, recruiters, screeners, trainers, client-facing evaluation teams, affiliated entities, or client organizations where operationally appropriate.

Introductory videos may be reviewed by internal teams and may be shared with client organizations or training/placement evaluators as part of screening, shortlist, placement, or engagement workflows.

Candidate media shall not be used for public marketing, advertising, testimonials, social media, promotional campaigns, or external brand content without separate written consent from the candidate.

Candidates are solely responsible for ensuring that uploaded media does not contain confidential employer information, patient information, third-party personal data, copyrighted content, unlawful content, misleading representations, offensive material, or content that violates the rights of others.

3. Profile Submission and Accuracy

Before final submission, you are responsible for reviewing all profile information, including manually entered data, auto-filled data, resume-parsed fields, uploaded files, salary expectations, job preferences, skills, experience, education, certifications, projects, languages, and portfolio links.

Submission of your profile constitutes a representation that the information submitted is true, accurate, current, complete, and not misleading.

The Company may rely on submitted, parsed, edited, uploaded, and system-derived information for screening, evaluation, matching, training enrollment, client presentation, and pipeline progression.

The Company shall not be responsible for adverse outcomes, non-selection, delayed review, misclassification, missed opportunities, client rejection, training denial, or pipeline consequences resulting from inaccurate, incomplete, outdated, misleading, or uncorrected candidate information.

You must promptly update your profile if material information changes, including contact details, availability, work experience, education, salary expectations, relocation willingness, travel willingness, notice period, or legal ability to participate in any role.

4. Sensitive Information and Prohibited Submissions

You must not upload or submit information that is unnecessary, confidential, unlawful, or unrelated to the Talent Platform process.

Prohibited or discouraged submissions include actual patient records, Protected Health Information, client records, employer confidential files, trade secrets, third-party personal data, Social Security numbers, government identification numbers, bank credentials, passwords, medical records, criminal records not specifically requested, or content that violates the rights of another person.

If you voluntarily submit prohibited or unnecessary sensitive information, the Company may delete, restrict, ignore, retain for legal defense, or otherwise handle such information in accordance with applicable law and operational necessity.

The Company disclaims liability for sensitive or third-party information submitted by a candidate contrary to instructions, except to the extent required by applicable law.

5. Background Checks and Consumer Reports

These Terms do not constitute authorization for any third-party background check, criminal history report, credit report, employment verification report, reference report, education verification report, identity report, or other consumer report.

If the Company or any client seeks to obtain a background screening report or other consumer report subject to the Fair Credit Reporting Act or similar law, you will be provided a separate disclosure and authorization where required by law.

Under the FCRA, before obtaining a background screening report, employers must provide a clear and conspicuous written disclosure and obtain written authorization from the prospective employee.

Refusal to authorize a required background check may affect eligibility for certain roles, clients, training pathways, placements, or engagements, subject to applicable law.

6. No Guarantee of Employment, Training, Placement, or Client Review

Creation of a Talent Platform account, profile submission, resume parsing, video submission, training routing, recruiter review, pipeline progression, iSpring enrollment, or client visibility does not guarantee selection, training admission, certification, interview, placement, employment, engagement, compensation, or client review.

All screening, evaluation, training, placement, and client-presentation decisions remain discretionary and subject to internal standards, role availability, client demand, candidate performance, eligibility, operational needs, and applicable law.

The Company may discontinue, modify, suspend, or terminate any candidate workflow, role track, training pathway, or client-matching process at any time without creating liability, except where prohibited by law.

7. Candidate Confirmation and Consent

By checking an acceptance box, creating an account, uploading a resume, submitting a profile, uploading media, completing the onboarding wizard, or proceeding through the Talent Platform, you acknowledge and agree that:

  1. you have read and understood these Terms and our Privacy Policy;
  2. you consent to collection, processing, parsing, storage, review, sharing, and use of your information as described in these documents;
  3. you are responsible for verifying and correcting all auto-filled or parsed data;
  4. you authorize the Company to use uploaded profile media and documents for screening, training, matching, and client evaluation;
  5. you understand that participation does not guarantee employment, training, placement, compensation, or engagement.

8. Modifications

The Company may update or modify these Terms at any time. Updated versions may be posted on the Talent Platform or otherwise made available to candidates. Continued use of the Talent Platform after updates constitutes acceptance of the revised Terms.
